Fiora Furniture Brand products are covered under a limited warranty to be free from defects in materials and/or workmanship for a period of five years from the date of initial shipment with the following exceptions: high wear parts such as glides, fabrics rated less than "A" heavy duty under the Association of Contract Textiles guidelines, other covering materials, and wood veneers.
This limited warranty is offered only to the original end-user customer acquiring the product directly from an authorized Fiora Furniture dealer. The end-user remedy pursuant to this warranty is limited to repair or replacement at Fiora Furniture's option. Fiora Furniture's consent must be obtained before any warranty work is performed. To obtain performance under this warranty, the defective product must be returned to Fiora Furniture or to one of its authorized dealers with proof of original purchase, including date delivered, which is required for warranty claim.
This warranty is valid only under normal and proper use of the products and does not apply nor does any other warranty apply to products which must be replaced because of normal wear and tear, product misuse, abuse or negligent use, damages sustained in-transit caused by any carrier, which will be handled under separate terms, modifications or attachments to the product that are not approved by Fiora Furniture, products that were not assembled, installed, used or maintained in accordance with product instructions or warnings. Some natural variations occurring in wood, leather or other natural materials are inherent to their character, and cannot be avoided and, as such, are not considered defects for purposes of this warranty. Fiora Furniture does not warrant the color-fastness or matching of colors, grains or textures of materials.
The warranty shall be void for acts of God, war, civil commotion, governmental action, fire, storm, flood, explosion, strikes, walkouts or any other cause that is beyond reasonable control. Additionally, the warranty is null and void if the customer fails to perform normal maintenance service on the product, which includes, but is not limited to, lubrication and cleaning, minor adjustments, and periodic operational checks. Normal usage for seating is defined as the equivalent of a single shift, 40-hour work-week when the product is used by a person weighing 250 pounds or less.
TO THE EXTENT ALLOWED BY LAW, FIORA FURNITURE MAKES NO OTHER WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL FIORA FURNITURE BE LIABLE IN EITHER TORT OR CONTRACT FOR ANY LOSS OR DIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES.
